Requirements for Canadian Citizens

Canadian citizens usually do not need a visa as a NAFTA Professional, although a visa can be issued to qualified TN visa applicants upon request. When Does a Canadian NAFTA Professional Need a Visa? A Canadian residing in another country with a non-Canadian spouse and child would need a visa to enable the spouse and child to be able to apply for a visa to accompany or join the NAFTA Professional, as a TD visa holder. Canadians applying for a visa will follow the same documentation requirements as shown in the sections Mexican Citizens, Applying for a TN Visa, and Required Documentation.

TN NAFTA Professionals

The North American Free Trade Agreement (NAFTA) created special economic and trade relationships for the United States, Canada and Mexico. The TN nonimmigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level.

Among the types of professionals who are eligible to seek admission as TN nonimmigrants are accountants, engineers, lawyers, pharmacists, scientists, and teachers. You may be eligible for TN nonimmigrant status, if:

You are a citizen of Canada or Mexico
Your profession qualifies under the regulations
The position in the United States requires a NAFTA professional
You have a prearranged full-time or part-time job with a U.S. employer (but not self-employment - see documentation required below)
You have the qualifications of the profession
Eligibility Criteria for Canadian Citizens

If you are a Canadian citizen, then you are not required to apply for a visa with a U.S. consulate or file a petition with U.S. Citizenship and Immigration Services (USCIS). You can request admission as a TN nonimmigrant at a U.S. port of entry, and you must provide the following documentation:

Proof of Canadian citizenship
Letter from your prospective employer detailing items such as the professional capacity in which you will work in the United States, the purpose of your employment, your length of stay, your educational qualifications
Credentials evaluation (if applicable)
If you are eligible following inspection by a U.S. Customs and Border Protection (CBP) Officer, then you will be admitted as a TN nonimmigrant. Form I-94, Arrival/ Departure Record, will be evidence of your admission

yeah, i forgot about this one (I didn't know one can get it at the boarder)...but if I am not mistaken there is a list of occupations which qualify for this visa?

Yes, there is a list, but I do not know where to find it.

Поясните, пожалуйста, если в указанном списке отсутсвует профессия, то гражданин Канады не сможет выехать на работу?

Или наоборот для профессий из этого списка требуется получить визу, а остальные могут без визы?

Если профессии нет в вышеуказанном списке, то визу TN естественно не дадут.

Но можно попробовать H1B - там танцев с бубном побольше, да и далеко не каждый работодатель захочет связываться с оформлением.

Вполне возможно.

Но нужно учитывать, что НАФТА - это трехсторонее соглашение, и изменения должны быть по идее согласованы всеми сторонами и на это потребуется много времени.

а-а-а и хорошо, что долго придется менять: я все-таки нашла нужную профессию в этом списке.
