Канадец живу в Киеве готовлюсь к спонсорству жены с Украины

Здравия всем и самого наилучшего! Я гражданин Канады/России 28 лет сейчас проживаю в Киеве и имею Вид на жительство в Украине. Вопрос таков: В анкетах будут вопросы про работу и место проживания, по Канадскому паспорту(без визы) я могу находиться в Украине не более 3 месяцев в 6 месячный срок, я живу здесь(Киев) с ноября 2011, как истёк срок пребывания я вьехал как Россиянин, потом получил ПМЖ(Да, уже второе в моей жизни, никак не думал), а потом для свадьбы в Ноябре 2012 вьехал опять как Канадец. В цовокупности как Канадец я прожил около 5 месяцев, а остальное время как Россиянин резидент Украины. Будет ли это учитываться так как мы жили естественно вместе, но я тут не работаю официально(музыкант).Будут ли вопросы или сомнения во мне как в спонсоре? Мол в Канаде ан момемт подачи не живёт и не работает? Нужно ли вернуться в Канаду для подачи, ведь как раз для легитимности важнее, что мы живём вместе уже больше года, но для моей финансовой стабильности? Я читал жён если вызывают на интервью спрашаивают где работает муж, а не работаю получается. На момемнт выезда из Канады был МА студентом в университете и жил с родителями.

Вам надо доказать, что к моменту лендинга вашей супруги, вы будете проживать в Канаде... Другой вопрос - как это лучше сделать в вашем случае? Возможно, стоит поехать в Канаду, снять жилье, найти работу и т.п.
Для доказательства отношений не так уж обязательно жить вместе долгое время - мы "жили" вместе 3 раза по 5-7 дней и все прошло гладко, они принимают во внимание и другие факторы.
Медицина, отправка документов - 11/2010. Спонсорство - 01/2011. Документы в Москве - 01/2011. AOR - 02/2011. POVL - 06/2011!!!

Большое спасибо за ответ Yael ! Мне бы ещё хотелось услышать от кого-то, кто на момемнт подачи проживал в стране где живёт супруга или супруг, а не в Канаде.
Я нигде не нашёл в правилах, что я обязан проживать в Канаде при подаче, только есть упоминание, что если так то потом показать ваше намерeние жить в Канаде, но что иконкретно им нужно? Может плохо искал? У кого-то есть подобный опыт? Подскажите?

If I live outside Canada, may I sponsor?
If you are a Canadian citizen, you may sponsor a spouse, a common-law partner or conjugal partner, or a dependent child who has no children of his or her own. However, you must demonstrate that you will live in Canada when the sponsored person becomes a permanent resident.
Note: Permanent residents residing abroad may not sponsor from outside of Canada. Canadian citizens travelling as tourists are not considered to be residing abroad.

Но это не конкретно, зато есть следующая секция закона
5.33. Exception to minimum necessary income requirement
The ability to meet the minimum income requirement is mandatory, unless the sponsor is sponsoring a spouse, common-law partner, conjugal partner or a dependent child where the child has no dependent children of their own. This exception also applies to persons under the age of 18 whom the sponsor intends to adopt in Canada."

Вот и пойми их, закон говорит, что если идёт речь о спонсортстве супруги или супруга, то это не обязательно(требование минимум дохода), но в описании кто может быть споснсором на этом же сайте пишут, что всё таки должен соответствовавть некоторым требованиям о доходе.

Вот нашёл тот самый мимимум средств, но учитывая секцию 5.33 он не должен распростроняться на тех кто споснирует супруга или супругу (дети которых, если они есть, не имеют своих детей(т.е. внуков спонсируемого(ой))

13.2. Residency requirements for sponsors
In assessing residency requirements for sponsorship purposes the IRB Appeal
Division ruled that a sponsor must maintain a significant connection to Canada.
Officers should consider whether the prospective sponsor:
• maintains a residence in Canada;
• has spouse and/or children resident in Canada;
• has assets in Canada;
• pays Canadian income tax on global income;
• visits Canada regularly;
• maintains investments, bank accounts, health insurance or club memberships in
Canada.
Sponsors may be found ineligible to sponsor if:
• they maintain residences in two countries at the same time;
• they have a house in Canada, but work abroad;
• they have interrupted their residence in Canada or spend little time in Canada.
Foreign stamps or post marks on the envelope, a foreign employer or the
sponsor’s non-Canadian address are indications the sponsor may not be residing
in Canada;
• there is evidence that they will leave Canada soon after the sponsored applicant
becomes a permanent resident. Sponsors must satisfy an officer they will
continue to reside in Canada after the member of the family class becomes a
permanent resident;
• sponsors are not ineligible if they take short holidays or business trips outside
Canada.
Note: For more information on IRB appeal division ruling see Athwal v. Canada (Minister of
Citizenship and Immigration) (1998).

13.3. Sponsorship by Canadian citizens living abroad
The following applies to Canadian citizens living abroad:

• Canadian citizens who reside abroad may sponsor only their spouse, common-law
partner, conjugal partner or a dependent child who does not have dependent children
of their own;
• they must submit their sponsorship application package and fees to the CPC-M in
Canada and not to the visa office;
• Canadian citizens who are tourists in a foreign country, even for extended periods,
are still residents of Canada;
• Canadian citizens who are long-term workers or students in another country are
generally considered residents of that country;
• Canadians who have spent little or no time in Canada may also seek to sponsor. If
they have never worked in Canada and do not have the educational or language
skills to find employment in Canada, refusal under A39 may be appropriate if
arrangements for the care and support of the sponsored person are not satisfactory;
• sponsors must provide evidence that they will reside in Canada after the sponsored
persons and their family members become permanent residents.
Evidence that sponsors will reside in Canada may include one or more of the
following:

• letter from an employer;
• letter of acceptance to a Canadian educational institution;
• proof of having rented/bought a dwelling in Canada;
• reasonable plans for re-establishing in Canada or severing ties to the other country.

17.3. Exemption
Financial requirements do not apply to sponsors of spouses, common-law partners,
conjugal partners or dependent children who have no dependent children of their
own, children to be adopted and children under their guardianship.
Therefore in assessing the eligibility of sponsors of the above family members, CPCM
and CPC-V do not need to consider the financial test. Nevertheless, sponsors of
these family members must complete the financial evaluation and sign the
undertaking and agreement, promising to provide for the basic requirements of the
sponsored family members.
If the sponsored person has dependent children who have children of their own, the
financial test is calculated for all family members.

130. (1) Subject to subsections (2) and (3), a sponsor, for the purpose of sponsoring a foreign national who makes an application for a permanent resident visa as a member of the family class or an application to remain in Canada as a member of the spouse or common-law partner in Canada class under subsection 13(1) of the Act, must be a Canadian citizen or permanent resident who

(a) is at least 18 years of age;

(b) resides in Canada; and

(c) has filed a sponsorship application in respect of a member of the family class or the spouse or common-law partner in Canada class in accordance with section 10.
Marginal note:Sponsor not residing in Canada

(2) A sponsor who is a Canadian citizen and does not reside in Canada may sponsor a foreign national who makes an application referred to in subsection (1) and is the sponsor’s spouse, common-law partner, conjugal partner or dependent child who has no dependent children, if the sponsor will reside in Canada when the foreign national becomes a permanent resident.
Marginal note:Five-year requirement

(3) A sponsor who became a permanent resident after being sponsored as a spouse, common-law partner or conjugal partner under subsection 13(1) of the Act may not sponsor a foreign national referred to in subsection (1) as a spouse, common-law partner or conjugal partner, unless the sponsor

(a) has been a permanent resident for a period of at least five years immediately preceding the day on which a sponsorship application referred to in paragraph 130(1)(c) is filed by the sponsor in respect of the foreign national; or

(b) has become a Canadian citizen during the period of five years immediately preceding the day referred to in paragraph (a) and had been a permanent resident from at least the beginning of that period until the day on which the sponsor became a Canadian citizen.

Напишите в тему "Сроки рассмотрения" - там больше людей обшаются и недавно обсуждалась похожая ситуация. И вот тема, где обсуждали отказ в спонсорстве http://www.rusforum.ca/topic12940.html как раз по причине отсутствия мужа в Канаде.

Из примеров - у нас знакомые сейчас как раз живут в России, но муж продолжает оплачивать бейсмент и плюс у него какой-то бизнес.

На момент подачи вы не обязаны проживать в Канаде, а вот на момент лендинга - да. Канада дает ПР человеку без знания языка и нужной профессии (вашей жене) по вашей просьбе и под вашу 3-летнюю финансовую ответственность, поэтому

Боюсь, вы нигде не найдете список документов, который удовлетворит посольство. Но если посольству что-то не понравится, то либо запросят дополнительные документы, либо откажут :(
